TERMS: "Inside telephone wire" is defined as the wires that run from the demarcation point (usually a small box on the outside of the home) to the telephone jacks inside the home. "Inside telephone wire" does not include complex wires or wires that are connected to telephones, or other equipment. "Inside cable wire" is defined as the coaxial cable wires that runs from connection point to the T.V. set or other related equipment. "Inside cable wire" does not include complex wires that are connected to T.V. sets or other equipment.
When Premier Communications is notified by the customer of service problems, Premier Communications will identify whether the problem is with the customer's inside telephone wire, inside cable wire, telephone jacks or cable outlets or whether equipment may be the problem. If the trouble is covered by Premier Communications, Premier Communications will repair or correct the trouble in a reasonable manner. The customer acknowledges that Premier Communications may reroute wire along baseboards and other locations to avoid replacement or repair of drywall, plaster or other materials and to avoid unnecessary work.
Excluded from coverage under these conditions:
Repair or replacement of the wire connecting the telephone or other equipment to the telephone jack.
Rewiring after a home is destroyed or damaged by fire, flood, earthquake, Act of God, vandalism, gross negligence or willful damage.
Initial installation of service and the installation of new jacks, new wiring or rewiring. These services will be performed at our regular installation and service rates.
Cable or wiring that runs between or among separates buildings, apartments or dwelling in a multi-tenant property. If customer resides in a multi-tenant building, campus or military housing, we suggest they discuss inside wire repair responsibility with the manager or owner.
Repair or replacement of any inside cable wire or cable outlets not installed by Premier Communications.
Repair or replacement of any inside telephone wire and telephone jacks not installed or existing in accordance with accepted industry standards as determined by Premier Communications.
Inside cable wire and cable outlets used to receive cable or other video services provided by another company.
Inside cable wire and cable outlets used to receive unauthorized cable service.
Trouble or problems existing prior to establishment of cable television service or prior to selecting the Premier Communications wiring service.
Repair or replacement of telephones, answering machines, t.v. sets, VCRs, set-top boxes used for channel selection or equipment leased or provided for receiving video or other services or any other equipment. Some equipment may be provided and maintained by Premier Communications and may be repaired or replaced as part of the customer's service.
Premier Communications may immediately, and without notice, suspend or discontinue terms to a residence if Premier Communications television service is no longer being provided to the residence by Premier Communications or if any misuse or abuse of the service occurs or if a hazard or danger to person or property exists which would prevent our techs from performing the work in a safe manner.
Subject to any applicable rules or laws, Premier Communications may discontinue these Terms & Conditions. We will provide 30 days prior written notice of any significant changes in the Terms & Conditions. This notice may be included in the customer's bill. The customer may discontinue the Premier Communications service at any time by calling customer service.
Premier Communications shall not be liable for any injuries to persons or property arising out of installations, maintenance or repairs performed nor shall Premier Communications be liable for any other damages including, but not limited to, indirect, incidental, special or consequential damages, arising from the customer's use of or inability to use such inside telephone wire, inside cable wire, telephone jacks or cable outlets.
PREMIER COMMUNICATIONS EXPRESSLY DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES RELATED TO THESE TERMS AND CONDITIONS. THIS DISCLAIMER EXPRESSLY INCLUDES, BUT IS NOT LIMITED TO, DISCLAIMER OF ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
